It doesn't hurt/help that this Batman has already lost his Robin, if not more members of the Bat family to injury and death. Likewise there are those who feel that Batman's motivations are explicable since he is only shown killing somebody in a moment of desperation, such as when he's trying to acquire kryptonite or rescuing Martha.The jury is out if Snyder's defense of Batman as "manslaughter" rather than "murder" is either hair-splitting or a more nuanced take on Batman's "no-kill" policy. The tie-in books and comics clearly say he may be brutal but he never kills them, but the movie itself as well as Word of God explicitly contradicts this.
